What happened to Senator Dino Melaye he now disrespects our democracy to the extent of showing disdain for the poll results.  Senate President Saraki’s seat  had more challenges was the choice of the upper chambers hence we stood against attempts by the dictatorship that tried to unseat Senate President Bukola Saraki.  
Nigeria’s desperate dictator applies any and all undemocratic tactics to stifle opposition. Was Dino blackmailed to get him into “I was blind now I can see”  posture as he stated at the recent senate sitting to the extent of now jabbing at  Rt. Hon. Speaker Dogara whose house  has put budget 2016 under scrutiny for the right reasons so that profligacy be not perpetuated by those refusing to lead through PMB “executive example”? Not only the house of reps is scrutinizing 2016 budget. We read of Senator Remi Tinubu’s damning statement against the budget a day or two ago. Other senators also said the total figure is N6.33 Trillion whereas the Executive lied to the nation that the final figures didn’t change when they tinkered with it So why whip the Rt Honourable Dogara for a corrupt budget?

Nobel Laureate Professor Wole Soyinka has called for the punishment of all those who were responsible for the demolition of a section of the Artists Village in National Theatre, Iganmu, Lagos.
At a press conference in Lagos yesterday, Soyinka, alongside former National President of Association of Nigerian Authors (ANA), Odia Ofeimum, among other prominent film and creative arts stakeholders, described the demolition of some sections of the Artists’ Village as “travesty of justice.”
‎It would be recalled that some sections of the Artists Village within the premises of ‎National Theatre, Iganmu Lagos were demolished on Saturday January 23, 2016, allegedly on the order of Minister of Information and Culture, Alhaji Lai Mohammed and Director General of National Arts Theatre, Yusuf Kabiru.
The minister visited the scene of the demolition and refuted the allegation, saying his orders were for the demolition of shanties and illegal structures within the theatre.
‎But at the briefing in Lagos, the Nobel Laureate said it was  ironical that those who should strengthen democracy were the ones who often deployed  “military mentality” in handling civil cases.
“‎To me, democracy means a humane approach to governance. Relate with other people as human beings and not as rodents, that you can do away with. At the moment I am not apportioning blames. I am addressing what happened on Saturday. This I hope will lead to enquiry as to who did what? Who gave the order?  ‎Who brought arms? The police, army? Who authorised the police? This time, we don’t want to hear about the usual Oga at the top? We must get down to the nitty, gritty,” Soyinka said.

It seems things are falling apart so quickly in the house of the All Progressives’ Congress (APC), as the wife of the national leader of the ruling All Progressives Congress (APC) Senator Remi Tinubu has mocked President Muhammadu Buhari’s government during the Senate plenary today, January 26.
Tinubu’s wife said that the change now experienced by Nigerians is not what was expected.

As President, in which capacity he was being interviewed, he was expected to be more circumspect in considering and volunteering information. On the arrest, detention, arraignment and trial of Mr. Nnamdi Kanu for treasonable felony, for example, the President could hardly contain his annoyance. He referred to the campaigner for resuscitation of Biafra as “that one you call Kanu”. He did not deny having a preference for continued detention of the man, despite a bail order by the court, thus giving the impression that he has no respect for the judiciary and its decisions.”
Mrs Tinubu also stated that the Buhari’s administration will incur the wrath of women if something is not done to improve the allocation to the women’s affair ministry. Mrs.Tinubu also accused the government of abandoning women in IDPs.
Buhari’s ministerial list of 36 nominees has only six women. Five are from the North and one from the Southwest.
According to the Nation ” President Buhari should note that no arm of government is necessarily superior to the other. Under the Rule of Law that should prevail in a democracy, supremacy of the executive is a strange doctrine. No man or institution of state has the right to be complainant and judge in its own case.”

Flay government’s disrespect to court orders, Rule of law

At home, his administration is stepping up efforts through the Economic and Financial Crimes Commission (EFCC) to prosecute those who have been fingered for their involvement in the various scams that took place in the immediate past regime.
Corruption in Nigeria, no doubt has brought this country to its knees and impoverished its people for too long that this time around, it must be confronted head on in order to eliminate its adverse effects.
A Lagos constitutional and human rights lawyer, Carol Ajie, said that corruption destroys nations and their people which must not be allowed to thrive for any reason. Her words: “Corruption destroys nations and their workforce, reduces productivity, hinders development, worsens poverty, marginalizes the poor, and hence these issues raise human rights concerns for all. The economic effects of corruption lead to the conversion of public wealth to private and personal property, imbalanced economic development, poor work ethics and professionalism, hindrance to the development of fair market structures and unhealthy competition. Corruption has tied this country’s development down and left the common people scrambling for survival amidst plenty.
This was why President Buhari was voted for in March 2015 so that we may not as a nation continue with the embarrassing conduct of business as usual”
In the same vein, American Secretary of State, John Kerry on a global stage at the 2016 World Economic Forum in Davos, Switzerland, while acknowledging the efforts Nigeria is making at home to curtail this epidemic, painted a gloomy picture on how corruption destroys nations, businesses and investments when he said: “Corruption is an opportunity destroyer because it discourages honest and accountable investment; it makes businesses more expensive to operate; it drives up the cost of public services for local taxpayers and it turns a nation’s entire budget into a feeding trough for the privileged few.”
With the seriousness that the fight against corruption demands, a lot of people are raising doubts whether the Buhari administration is also seriously committed in ridding this country of corruption with the method he is adopting in the fight which is already raising concerns of whether the nation will finally reach the Eldorado.
While many will welcome an all-inclusive fight that will carry people along and heal the wounds in the land, others are kicking against selective prosecution of perceived political opponents geared towards victimization and vendetta that will only breed bad blood.
Reacting to this notion, Ajie said ‘US Secretary of State John Kerry was right when he reminded the audience at the World Economic Forum, that President Buhari inherited a corrupt system. Hence all Nigerians irrespective of political parties must urge Buhari to launch sincere and honest war against graft either against APC or PDP considering the fact that national agencies cover 36 states of the Federation’.
She admonished: “Buhari must be above board himself, he and members of the first family cannot effectively fight corruption and be perceived as guilty as was reflected in his 2016 budget of profligacy for a President who rode to power on the crest of a Spartan lifestyle, retaining the luxuriant fleet of aircraft he inherited from his predecessor-in-office and maintains the presidential fleet at the cost of N1.8billion per month, which can be money capable of transforming the lives of thousands of internally displaced persons and their families in the North East.
Buhari must imbibe the spirit of self-sacrifice like the new President of Tanzania, John Magufuli who implements austere programs for himself and others. Buhari’s priority within four weeks of his swearing-in was the construction of a helipad in his hometown Daura at the cost of $500,000 and to now desire N4billion for Aso Rock clinic and N800 million for website construction, in the budget as items, are very absurd and sets the citizenry against a kleptomaniac mindset”.
Under democracy, war against corruption is fought and won or lost through the court system and respect for the rule of law. The issue now is to interrogate the capacity of the Nigerian courts to handle the increasing number of corruption cases and the President’s preparedness to respect the rule of law.
It is even being contemplated whether the country can establish special courts to handle the corruption cases, as well as declare a state of emergency on the pandemic.
In his reactions to these issues, Lagos lawyer and a senior advocate of Nigeria, Norrison Quakers, admonished that the government should not combat corruption frontally at the expense of other areas of the Nigerian polity that needs to be addressed because corruption is not the only problem confronting the country.
He stated further that, if the laws and the enforcement agencies are efficient and effective, the ways and manner corruption is being fought would not have arisen.
“In other developed climes where public officials are found to be corrupt, they will be arrested, prosecuted and convicted accordingly, because it has been entrenched in their system.
That is why people are raising questions concerning the nation’s own prosecutions have become a show. Of course, the aspect of public spectacle is psychological, even when there is also a constitutional provision that anyone who is arrested for an offence is presumed innocent until proven guilty by the law. The aspect of arraigning and displaying to public spectacle is a showcase of guilt which runs contrary to the constitutional provisions. Again, you don’t arrest a man and subject him to detention without trial beyond the constitutional provision of 48 hours”, he said.
Quakers also reacted to non-compliance to court orders by the Federal Government stating that, “If a person had been granted bail and if there are reasons for re-arrest, it must not be for the purpose of the charge for which he had been granted bail.
“ If there are other cases pending against him, the government must first show that he had complied with the order of the court granting the accused person bail, then it can subsequently have another case against him”, he advised.
He pointed out that, this must have prompted the Chief Justice of Nigeria recent order that courts should stop granting remand orders to EFCC.
“In developed countries, when a person is arrested, he will be granted administrative bail. The essence of bail is that you will be present at your trial. But in some instances, you might be denied bail and that is, if you are likely to jump bail or not present yourself for trial”.
To Quakers, ‘it is indeed a welcome development that those who were suspected to have plundered the country’s commonwealth are not treated as sacred cows. But I think the government should also saddle itself with responsibilities from other areas of the economy.
“I believe we should not sensationalize the crusade for ill-gotten wealth, but adhere strictly to the law. In a democratic dispensation the rule of law must prevail and the constitution must be supreme”, he added.
On the change of attitude of the people generally, he stated that: “For the first time in the history of this country, everyone is now conscious and careful of what he does, most especially, government officials. People are now going into government with every sense of responsibility. It is no more business as usual. If this alone is what this government has achieved, I think that is good”.
Corroborating Quakers on the issue of rule of law in prosecuting alleged corrupt people, Dame Ajie said: “In a democracy, in the 21st Century where the rule of law ought to be promoted as alternative to chaos, disorder and dictatorship, President Buhari made a public declaration at his maiden media chat in December 2015, in front of TV camera and denounced subsisting court orders that are unfavourable to him. Many citizens, institutions and the Nigerian Bar Association frowned at him for his disrespect of court orders, as the war against corruption must be won legitimately by applying lawful tools.
“Having taken the Oath of Allegiance to protect the Constitution of the Federal Republic of Nigeria and the Oath of office to discharge his presidential duties as distinct from ‘personal’ duties faithfully, in accordance with the Constitution and the Laws of Nigeria without ill-will or personal animosity, President Buhari must respect the revered Oaths he took voluntarily, not being permitted to demonstrate lack of respect for Court Orders or to make puerile attempts to justify it in stating that some persons his regime arrested and detained under dehumanizing conditions against subsisting court orders, must remain so detained. That has been rejected by all civilized nations as it tends to promote anarchy”.
On his on part, Quakers advised government to understand why Nigeria is facing the predicament of corruption and why the people are fighting the war against corruption. He also stressed the need to have a principle that will checkmate public office holders such that it will no longer be business as usual.
“In the United Kingdom, there are laws similar to what we have in the EFCC. But our problem is that these laws are not applicable or implemented as they should. Look at the motto of the EFCC, which reads thus: ‘Whatever you do, wherever you go, EFCC will get you’.
To me it looks like a vindictive provision and I think we should do something to change this impression. Laws are to reform and not to arrest and punish.

Making her contribution to the debate on the 2016 budget on the floor of the senate on Tuesday, Tinubu lamented that APC promised to run an inclusive government with the women well represented, the budget does not reflect the promise. Wondering why the ministry of women affairs, which carries out several responsibilities, got the least allocation in the budget, she asked the upper chamber of the national assembly to look into the issue in order to avoid the wrath of women. “In its manifesto, the APC mentioned the need for empowerment programmes for Nigerian women,” she said. “Such comprehensive empowerment requires fund which should be included in the budget for implementation. Going through the budget for the federal ministry of women affairs, I discovered that the total allocation to the women ministry is so meager and I think it would be the least allocation allotted to a ministry. “And when we look at the functions of this ministry – the ministry is divided into two divisions: human resources and capacity building, economic services and women cooperative – but when we look at the first division, which is human resources and capacity building, they are supposed to promote education, development of women in the civil, political, socio-cultural and economic sectors. “All these that I have also mentioned require capital. Looking at this budget of less than N4bn, they have capital with almost N3bn. So, when you look at it, what is left? “I am just laying this case on behalf of the Nigerian women. This is not going well… It’s as if we were used during the campaign, and we said this is a government of change. The change mantra is supposed to change things across board. “What they have allotted to the Nigerian women is not encouraging. When we talk about change, it doesn’t mean we are going to dodge and support what is not working. “This is the best way to start. So that the women would not just be used for campaign and several promises made to them. Former Minister of Finance and Coordinating Minister of the Economy, Dr. Ngozi Okonjo-Iweala, has described as a joke attempt by Lagos lawyer, Mr. Femi Falana, to link her to the controversial $2.1 billion arms scandal.

In a statement by her media adviser, Paul Nwabuikwu, the ex-minister said “the malicious attempt by Lagos Lawyer, Femi Falana to mix Dr Ngozi Okonjo-Iweala up in issues that have nothing to do with her in his letter to the International Criminal Court (ICC) is a desperate joke by an integrity challenged charlatan (ICC).”
Okonjo-Iweala said: “This misadventure shows that the so-called learned lawyer does not have any idea of what the mandate of the ICC is about.
He has resorted to this action because his previous efforts to tarnish her name – through petitions to the EFCC – failed because they were lacking in credibility.
“This latest effort to try to attach her name falsely confirms that Femi Falana is nothing but a tool of corrupt elements whose interests were hurt by the work Dr. Okonjo-Iweala did in fighting corruption while she was in office.
“These elements have now made a habit of making false allegations against Dr Okonjo-Iweala whenever she receives any national or international recognition for her work. The pattern is clear and Nigerians should be alert to it. But Dr Okonjo-Iweala will not be intimidated from going on with her life and performing her duties. She will not give in to cowardly and unmanly bullying.
“Falana’s latest attempt to implicate Dr Okonjo-Iweala falsely suggests that he is suffering from an ailment that may be described as Chronic Cerebral Amnesia (CCA) because he simply has no grasp of the facts.
“Here are the facts: one, contrary to Falana’s lies, Dr. Okonjo-Iweala has absolutely nothing to do with the alleged misuse of $2.1billion by the office of the former National Security Adviser. Falana and his sponsors are simply trying to invent a connection where there is none.
The January 20, 2015 memo in which Dr Okonjo-Iweala sought and received the approval of former President Jonathan for the release of part of the newly returned Abacha funds to the NSA for purchase of arms is totally separate from the $2.1 billion issue.
“The memo which is now in the public domain speaks for itself. The release of the resources was in response to an approval by the former President following a meeting chaired by him after a committee had considered the request.
“The memo clearly documented Dr Okonjo-Iweala’s insistence that the proper procedure be followed, subject to appropriation and according to financial regulations. Dr. Okonjo-Iweala went further to state that the former NSA should account for the funds to the former President since she is not a member of the Security Council. The attempt to link Okonjo-Iweala to the $2.1billion issue is therefore dead on arrival.
“Fact two: Okonjo-Iweala was not in government when most of the Abacha funds were recovered. Falana and his sponsors have claimed that billions of dollars of Abacha funds were recovered and that Dr Okonjo-Iweala should account for the recovered funds.
The fact is that some of the funds recovery was done under the regime of General Abdulsalami Abubakar and the first term of President Olusegun Obasanjo when Dr Okonjo-Iweala was not even in government.
“During the time Dr Okonjo-Iweala was Finance Minister in the second Obasanjo administration, $500m was recovered. As documented by the Field Study conducted by the World Bank with the assistance of national and international NGOs, this amount was properly applied.
Falana’s insistence on the contrary shows how despicable he is and how he is ready to ignore facts and concoct a fiction in the service of his sponsors.
“Fact three: Okonjo-Iweala left strong legacies as a champion of transparency and the fight against corruption while in government. It is on record that Dr. Okonjo-Iweala championed transparency and vigorously fought corruption during her two terms as Minister. Among other actions, starting from the second Obasanjo administration, she, for the first time in Nigeria’s history, published monthly revenue allocations to all tiers of government for Nigerians to see.
“While serving in the Obasanjo administration, she requested the assistance of the World Bank and DFID, the UK’s development agency to build institutions and systems that could block leakages from the treasury. This work stalled after she left office in 2006. In August 2011 when she returned under the Jonathan government, with the assistance of the Ministry of Finance Team, she re-invigorated the establishment and use of the Integrated Personnel and Payroll Management Systems (IPPIS), the Government Integrated Financial Management System (GIFMIS) and the Treasury Single Account (TSA), all of which saved the country billions of naira by drastically reducing avenues for corruption in the public service. These facts are well documented in successive World Bank, DFID and IMF Article 4 Reports. It is gratifying that the present government has adopted and is further building on these systems for the benefit of the country.

“Fact four: Dr. Okonjo-Iweala’s mother was kidnapped and almost killed because of the former minister’s stance against corruption. Falana is callous beyond belief for ignoring a fact of recent Nigerian history: the kidnap of Professor Kamene Okonjo, the then 83 year old mother of Dr Okonjo-Iweala by agents of fuel subsidy fraudsters who were angry that the former Minister had blocked them from defrauding the country further.
“The kidnappers had told the traumatised old woman that they were sent to punish Okonjo-Iweala for refusing to pay some oil marketers. It is on record with the State Security Services that the kidnappers initially demanded the resignation of Dr Okonjo-Iweala in return for the release of her mother. Thank God Professor Okonjo is still alive to tell her story today and she will not be silenced.
“It is extremely insensitive and, in fact, inhumane for Falana and his sponsors to level false accusations against someone like Dr Okonjo-Iweala who went through this kind of searing personal ordeal for her principled fight against corruption.
“Conclusively, Falana’s attempt to implicate Dr Okonjo-Iweala falsely is a disservice to law, justice and the image of the country. It is sad that a person who had earned some prominence as a human rights lawyer now tramples on the human rights of others as a political jobber. He and his sponsors are engaged in nothing but media harassment, cyber bullying and intimidation against innocent persons like Dr Okonjo-Iweala for political and pecuniary gain. That is why Nigerians should not give in to Falana’s self-imposed Chronic Cerebral Amnesia (CCA),” said Okonjo-Iweala.
