Breaking.... African Bar Association Visits President Jammeh Gets Walloped in Gambia

The African Bar Association led by some Nigerian Lawyers in the close circle of  Messrs  JB Daudu and Alegeh  specifically Messrs Hanibal Uwaifo and Ibrahim Mark were in Gambia two days ago and met with President Yahya Jammeh according to this report below. A press statement in Gambia was said to have been issued by them which was pummeled  by  PALU and  GBA. (Gambia Bar Association)

In the Gambian radio link hereunder a damning statement against that delegation of the  African Bar Association said to have sold out and that the Gambia Bar Association and PALU dissociate itself from the delegation of the African Bar Association and that delegation’s integrity was walloped. It said PALU and GBA stand with UN and ECOWAS  and NOT Jammeh who annulled the presidential election  after he had conceded defeat and had congratulated the President-elect Mr Barrow .

A Global Champion for Change and human rights lawyer, Carol Ajie, has written an open letter to Nigeria’s President Muhammadu Buhari as he leads the ECOWAS charge in negotiating a relinquishing of power by sit-tight Gambian President Yahya Jammeh.
Dear Mr President Muhammadu Buhari,
With your permission, a mediation panel of the Bar Association should help resolve the Gambian imbroglio and steer Africa from a regional crisis roiling.
Some may say but NBA mediation committee on 2016 presidential election didn’t work so how could NBA perform the magic of intervention.
I suggest Mr President in your letter to AB Mahmoud SAN ask for the names of the lawyers who constituted a mediation committee that didn’t demonstrate the will to call a peace meeting of the parties, because they ought not feature in any further mediation exercise, with all due respect.
NBA has sixty thousand practicing lawyers plus, the association is not short of skills. I suggest a quick tip towards resolving President Jammeh’s tenure elongation bid. NBA ought to bring both sides President Jammeh and President-elect Barrow to sign a power pact ASAP.
Jammeh obviously does not want prosecution for the atrocities committed during his 22-year reign – disappearance of citizens, torture of political opponents, etc.
I Recall Barrow and his supporters publicly bragged about getting Jammeh to answer for his crimes after he had conceded the election; whereas Jammeh would prefer to leave office and live peaceably with his fellow citizens bearing in mind he had congratulated Barrow on Tape he, Jammeh aired to everyone.
Iconic Activist and Lawyer Nelson Mandela negotiated power with the Whites hence did not ‘prosecute’ those horrible hate crimes of the apartheid regime De Clark even got a Nobel peace prize.

Presidency Reacts: UN S-G APPOINTMENT OF DEPUTY SECRETARY GENERAL

I have just read online, one of your spokesmen this morning reaction says Minister  Amina Mohammed will be leaving office in March 2017.
 The UN Secretary General Guterras starts work in January 2017 and yesterday we read the glorious news of  3 or 4 major appointments across continents, ALL WOMEN in whose competences the Great Secretary General relies. In line with his pledge to #EmpowerWomen.   His administration will focus on “gender parity” he enthused.
 
March 2017 exit date for Amina Mohammed could be your prerogative perhaps  but the intent of this note Sir is not to question it.   Nigerians recall that in March 2016 we lost a Gem, James Ocholi SAN. He was Minister of State for Labour represented North – Kogi State.

 Amina Mohammed new Deputy Secretary General, UN,  represented North in your cabinet Sir  given the Nigerian Constitution compels at least one Minister per State.  Please Sir do not wait until March 2017 to nominate Ms Mohammed’s replacement. Afterall Donald Trump has started naming his cabinet members president-elect assigning porfolios to them preparatory to assuming office in Jan 20th 2017 much more one sworn-in and in the saddle  since May 2015. Please your Excellency  nominate one or two of  the Northern women as  there are two slots to be filled in your cabinet right now.  If you gave a great country Nigeria 52% female population with a national gender policy of 30-35% two more Northern women we still would be short-changed when you did in presidential campaigns pledged principles of gender parity please.

This is not a veiled note to dis-promote Southern Women.

The New UN Secretary-General, António Guterres, on Thursday announced Nigeria’s Environment minister, Amina Mohammed, as his Deputy Secretary-General.
Guterres made the announcement through the spokesman of the Secretary-General, Mr. Stephane Dujarric.
Guterres also announced the duo of Ms. Maria Viotti of Brazil and Ms. Kyung-wha Kang of the Republic of Korea into high-profile positions at the UN.
He said, “I am pleased to announce that I will be appointing Ms. Amina J. Mohammed of Nigeria as my Deputy Secretary-General, and Ms. Maria Luiza Ribeiro Viotti of Brazil as my Chef De Cabinet.
“I also intend to create the position of Special Advisor on Policy, and to appoint Ms. Kyung-wha Kang of the Republic of Korea to this new role.
“I am happy to count on the efforts of these three highly competent women, whom I have chosen for their strong backgrounds in global affairs, development, diplomacy, human rights and humanitarian action.

She provided advice on issues including poverty, public sector reform and sustainable development, and coordinating poverty reduction interventions.
She is also an Adjunct Professor in Development Practice at Columbia University, and serves on numerous international advisory boards and panels, including the UN Secretary-General’s High-level Panel on Post-2015 Development Agenda.
Others include the Independent Expert Advisory Group on the Data Revolution for Sustainable Development, and the Global Development Program of the Bill and Melinda Gates Foundation.
She is also the UN Secretary-General’s Global Sustainability Panel, the African Women’s Millennium Initiative, Girl Effect and the ActionAid International Right to Education Project.

“This is a very ambitious agenda, an agenda that must be for both woman and man, and that is why parity is so important in our reform perspectives.
“That is also why the empowerment of women is so important in everything the UN will be doing around the world.”
Guterres, succeeds outgoing secretary-general Ban, who bows out on Dec. 31, 2016 after a decade of two terms, while the new secretary-general assumes office on Jan. 1, 2017, for the next five years.

Lawsuit on NBA Election 2016: Gadzama -vs- Mahmoud, Alegeh et al



Court grants Gadzama’s application to adjourn sine die

          

The  High Court of the Federal Capital Territory ( FCT, ) presided over by Justice Y. Halilu sitting in  Jabi, Abuja,   on Thursday 1st Dec  granted an application by the acclaimed winner of the NBA Presidential election, Chief J-K Gadzama (SAN) asking the Court to adjourn  the matter sine die. In making the application, lead counsel to Gadzama, Chief Emeka Ngige (SAN) informed the court that his client has appealed the ruling of the Court in refusing consolidation - to hear the preliminary objections together with the substantive suit and that all the defendants have been served with the Notice of Appeal
Chief Gadzama had gone to  Court to seek redress  over the alleged  monumental irregularities  that trailed the NBA election and subsequent declaration of Mr. Abubakar Balarabe Mahmoud ( SAN) as the president of the NBA
The Court had on November 8, refused the application of the Plaintiff to consolidate the hearing of   preliminary objections with the substantive suit, a ruling which  the Plaintiff  appealed agaisnt to the Court of Appeal.
However lead counsel to the defendants, Messrs Olumuyiwa Akinboro (SAN), Dr. Garba Tetengi (SAN), J. S.Okutepa (SAN), S. I. Ameh (SAN) A. Mallick  vehemently opposed the application for adjournment sine die. They argued that the court of Justice is not a warehouse where cases are kept and locked down to be picked at the whims and caprices of the Plaintiff.
The defendants also argued that the Notice of Appeal served on them by the Plaintiff did  not contain the Appeal No. They also contended that there was no motion for stay of proceedings before the Court to arrant such adjournment sine die. Urged the Court to strike out the matter and if the Court was minded to adjourn the matter sine die, he should do so granting the Plaintiff three months adjournment so that he would have enough time to play and do whatever business he has at the Court of Appeal.
Responding to their Defendants’ contentions, Chief Emeka Ngige ( SAN) reminded  the Court that the Plaintiff was the one who filed the matter in Court, and  he is more worried and concerned about the expeditious determination  of  the matter than  the defendants. He therefore urged the court to grant the adjournment sine die in the interest of justice.
In his ruling, the Lower Court stated: “Once a Notice of Appeal has been filed and the lower Court formally informed considering it keeps the record proceedings. The Court must adjourn sine die pending the outcome of the appeal at the Court of Appeal. The suit was accordingly so adjourned.
