While Magu Spat, Alegeh Celebrating?




On Sunday 28th August 2016 whilst EFCC Chair Magu’s press release made news, Mr Alegeh wrote to his friends: “Please join me in thanksgiving to God to mark the end of my tenure as NBA President

Light refreshments after Church somewhere in a house in Ilabere Ikoyi Lagos.
Hi Colleagues,
You know what it means moving from Ikeja to Ikoyi, tortuous. With all the money he made  he couldn’t host his people in Ikeja for convenience of movement.
But that is not the angst, that Mr. Alegeh could not call 5 or 6 (more or less) of his colleagues aside to discuss Magu’s press release at the heat of the moment and possibly explain why he, Alegeh didn’t think he Alegeh, handed over a rogue association as Magu lampooned.
In the years I contested the office of General Secretary of NBA I would organize my birthday colloquium  in Federal Palace Victoria Island Lagos over sumptuous dinner to feed our intellectuality, resource persons (Lawyers) talked to Lawyers over prepared speeches and remarks on the latest Law and Court Rules. Mr Alegeh wasn’t nearly 50000 kilometres to NBA Leadership. He couldn’t even say to his learned friends on Sunday “lets discuss this Magu’s  statement lets form a public view” by now the public would have read or had him televised or even on radio:  “immediate past President of the Nigerian Bar Association Mr Alegeh SAN at his closing reception in Lagos called on EFCC to make a generous assessment of Mr Mahmoud’s inaugural statement in PH to see that he meant no harm; NBA  never intended to whittle down or ‘dwarfize’ EFCC or the anti-graft war.  But aimed at strengthening  its investigatory powers as laid out in the EFCC Act but to reserve prosecutory powers to a distinct office …….” With a view to boosting public morality, you pushback and preserve your profession.
Anyway Alegeh was/is not a public interest person even as he retires to mute.
The other day he was scheming to lead the council of African Bar leaders – JB Daudu was given the appointment by African Bar Association and Alegeh was all frown as if he need be reassured Daudu his benefactor.
Not about looking for Delta State road contracts.  My Brother-in-Law Patrick Ferife is married to my Blood sister Gloria a medical doctor,  Patrick Ferife was Commissioner for Land and Urban Development under Governor Uduaghan. I am not a contractor but proud Attorney like everyone else.  They fall over, mercenaries, for those family and friends opportunities, I deliberately avoid.

Substituted Service, Lawsuit on NBA Polls and Sundry Issues


ON FRIDAY a learned senior recalled that when ABM was campaigning for the office of the President, advised to ‘apply energy, open a website, Whatzapp, sms, make calls visit branches as others; ‘re-activize’ and  if you win NBA should have a voice in national discourse ’. He said ABM was not and he is still unhappy with him.

As it happened soon ECNBA declared the controversial poll result, ABM visited his Branch where ABM’s law partner is an indigene of Kebbi and was a former AGF Dikko. That Dikko had big domestic accident, a huge fracture and in hospital. So ABM visited the branch to thank them for supporting him and ABM deliberately went through a crafted protocol and bye passed him, he is actually the Bar Leader there but ABM spited him typifying Alegeh, Buhari picking victims even in the face of victory they express anger at critics if they had the powers they want to ‘annihilate’.  What if they had lost/lose the race would they smitten?  

The Branch Leader and ABM scowling…. You know the lawsuit challenging the July 30-31 election was called up on Friday 19 Aug at the FCT High Court Abuja before one of the vacation Judges and the Plaintiff’s motion ex-parte for substituted service was granted and asked to put the defendants on notice with reference to the Motion to restrain  adjourned to Thursday 25th Aug for hearing.

Mr Falana’s words reported in today’s Guardian hereunder last paragraph: “Falana, who was the chairman of the occasion, faulted the position of the Speaker of House Representatives, Yakubu Dogara, that budget padding is not a crime, adding: “Section 81 of the constitution says the President shall cause the budget to be prepared before the House, not the National Assembly influencing the budget.” He noted: “Today, I am not sure we have many lawyers of good conscience. We were hoping the NBA would do something about those lawyers who allow cases to go on for 15 years, but since the NBA is busy making money, it is time for lawyers of good conscience to distance themselves.”
The Economic and Financial Crimes Commission (EFCC) will no longer no longer condone lawyers who frustrate the fight against corruption through frivolous applications in court.
Chairman of the commission, Mr. Ibrahim Magu, made the assertion yesterday at a lecture organised by the National Association of Democratic Lawyers (NADL) held in Ikeja, Lagos, with the theme, ‘The role of Nigerian lawyers in the fight against corruption.’
He lamented the negative role of some lawyers he termed ‘rogue elements’ in frustrating the fight against corruption.

Similarly, Executive Secretary, Presidential Advisory Committee Against Corruption, Prof Bolaji Owasanoye, said the biggest threat to the success of the administration of criminal justice is the unchanging attitude of lawyers to the letter and spirit of the law.
He also lamented that some Judges continue to tolerate the dilatory tactics of lawyers, rather than enforce the spirit of the law fully.
“Ref, saying “refusal to recognised the import and impact of the legislation and continued attempts to delay progress of criminal cases, especially corruption cases, is a gross violation of the Rule 30 of the Rules of Professional conduct and ought to be severely sanction without equivocation.”
Magu, while praising legal practitioners for assisting the agency in their duties, said the commission has had to confront corrupt lawyers, warning that it would no longer condone them.
“Your direct confrontation of the corruption monster through the instrumentality of the law is an inspiration to those of us in the enforcement of the law.
“However, in the course of confronting the monster, we constantly run up against a gang of rogue elements who are not only frustrating the work that we are doing, but also give a terrible name to the Bar and Bench.
“The biggest form of corruption is the one that has eaten deep in the temple of justice. We are all witnesses to the abuse of ability, skills and knowledge of few rogue elements in the profession.
“The EFCC has no choice than to challenge senior lawyers, who are perverting the cause of justice. We are resilient to weed out corrupt individual, be it in the judiciary or otherwise. There is no time now in Nigeria than to say, enough is enough.”
Magu stated that under his watch, EFCC would come to the aid of shortchanged Nigerians and intervene where there is impunity.
He enjoined lawyers to work together with the agency, expressing readiness to partner with lawyers whose credibility can be vouched for, but would not stay idle and watch Nigerians being shortchanged.
Owasanoye, who was the guest lecturer at the event, said lawyers have a greater role to play in the fight against corruption, adding that the success of the fight against corruption depends on the cooperation of the Nigeria Bar Association (NBA).
“The role of lawyers in the fight against corruption is well recognised. Like Ebola and Cancer, corruption has eaten deep in the country until President Muhammadu Buhari came on board.
“Recent mind-bugling revelations of corruption emanating from the military arms contract have established the fact that the effects of corruption in Nigeria is not under estimated.
“If the fight against corruption fails, Nigeria has fail, because if nothing changes, the legal profession will not survive.”
He added: “The fight against corruption is not a tea party and when corruption fights back, lawyers are always collaborators.
“Fighting corruption requires resilient. If lawyers fail to fight against corruption, they are not fighting government, but society.
“The more corruption thrives, there will be more crimes such as kidnapping. Where a lawyer takes a bribe in the course of the fight against corruption, he is liable to prosecution.”
In his explanation on the obstacles in the fight against corruption and solutions, Owasanoye urged the federal government to extend the fight to state and local governments, pointing out that the whistle blower Act should be formed and witnesses protected.
“Creating an effective framework against corruption is important. By improving on characters of people voted into offices, both at the public and private sectors, it will diminish corruption.
“We also need to keep data of criminals. Inadequate funding of criminal justice is also a big problem, as well as poor oversight of the work of anti-corruption agencies, but the NBA must rise to the occasion,” he stated.

In his submission, Mr. Femi Falana (SAN) said the President must do more than declaring his assets by ensuring that his ministers and other public office holders follow suit.

Justice Abang's Politics; Abia Governorship Tussle

Dear Vanguard Editors,
The Lady Justice of the Court of Appeal who read the lead Judgment is not a man;  you said 5-man panel. Please 5-member panel. The Chief Judge of Abia State is also a Lady CJ. Not a man. Women need great men like yourselves to recognize their professional worth, there are women doing great deeds; telling the Justice Mr Abang that they have no right to display obvious partisanship. APC Judges. Her Lordship Justice Morenike said  “His Lordship turned the law on its head” “his judgment ridiculous”. That he “raped democracy”. Meaning a judicial officer is being engaged in acts of banditry that is gangsterism, desperate marauder and brigandry mowing down Nigeria’s hard fought independence and democracy. Were it not for APC regime backing brigandry and blackmailing Judges they have things on to write just anything, NJC would have asked Abang to quit.
Nigeria’s anti-democratic forces will meet Nigerians in  2019.

Lawsuit on NBA Election 2016 and the Doctrine of res sub-judice

Question: What does the doctrine of res sub-judice  say?
Answer: Not to swear in any of the parties into the office of the President of the Nigerian Bar Association at the forthcoming annual general conference slated to hold this week end till end of the week or at any time whatsoever pending adjudication and outcome of the pending suit.

Question: Is NBA to stall and or standstill?
Answer: Oh NO! NBA is not stalling our noble learned and honourable association preserved there is no division at all only our NBA democracy is aimed at  being strengthened to avoid future manipulations. So that our watch dog role be sanctified to enamour the moral standing on which to guide APC, PDP etc.

Question: How is the NBA to run now there is litigation to stop AB Mahmoud SAN?
Answer: There are others who have been fielded for the other offices of the 1st Vice President in the person of Caleb Dajan Esq and 2nd Vice President in the person of Monday Ubani Esq and the 3rd VP and the General Secretary in the person of  Olagunju and Assistant Secretaries and Treasurer and so on. The NBA will conveniently run, our Constitution says in the absence of the President the 1st Vice President acts.  Note that the learned Plaintiff JKG is concerned about the office of NBA President which he contested hence his locus to stand fully and challenge Messrs Alegeh, ABM now un-mistaken.

Question: Is AB Mahmoud SAN to be inaugurated with the other officers in AGC August 2016?
Answer: No please you cannot do that, the doctrine of res sub-judice says both ABM and JKG must await the court’s pronouncement on whether fresh elections would take place and when. If ABM had been sworn-in the reliefs would have altered to invalidate his actions in office but as he has not been sworn-in at the time the Writ was filed the doctrine of common law and equity hugely copiously recognized by our Courts compel all the defendants to WAIT.

NB:- Are you aware reputed NDI – National Democratic Institute has written to say
they did not observe the NBA e-voting election 2016 as alleged or at all.

I Agree Buhari's Government is Irresponsible!



Why I agree that Buhari’s government is irresponsible
1.  Buhari is the Father by way of speaking Father of the Northern and Southern poles; it is only an irresponsible Father that divides along poles – this child devoted only 5% votes to get elected as President the other child 95% yet refuses the non-voting child to look for a nice foster parent.

2.  A wicked Father that locks the children in a room to starve them because they dedicated only 5% of votes to him.

3.  A wicked Father that would assume office as President and dedicates a quarter of his term seeking for Ministers and Aides to assist him and behold appoints recycled hands.

4.  A wicked Father promised to revamp the economy so that in creating the right environment for businesses to thrive they will be independent but then gets so slow that the economy is now sliding into a recession and won’t seek economists to.

5.  A wicked Father looks away his wife bears Hermes Croc bag worth over N40Million yet school fees of poor Nigerian kids are being increased; children are being sent out of school!.

6.  Wicked! His natural born children all school abroad. President Jonathan had his children school in Nigeria even as President of the Federal Republic of Nigeria.

7.  PMB at the time he was voted in and inaugural ceremony done Naira exchanged at N120/$1 in the parallel market. Today exchanges at N390/$1 in the same parallel market.

8.  It took PDP 16 years to bring down the Nigerian economy for those of us who failed to see the economy index at the time, but it is taking APC/Buhari only 16 months to destroy it more.

9.  We read APC Chair John Oyegun at his 77th birthday say APC did not realize so much damage had been done at the time they campaigned; so now they see  they have not the solutions now what? Resign! But like the wicked Father they are holding on sinking the ship deeper and further more children endangered after they had secured for themselves and their families and friends maximum benefits.

10.              Till date Buhari has no economic team even in the face of recession and galloping inflation!!!! If that is not a deliberate act of wickedness to intentionally punish Nigerians for not voting for him at previous elections, then what is?

Warren -vs- Trump : Attn MUW



I was the Chief Justice of Nigeria,  the second longest serving 1995 – 2006  after the Rt Hon. Adetokunbo Ademola first indigenous Chief Justice of the Federation 1958- 1972 He was Chief Justice for fourteen (14) years and I was CJN for eleven years (11). When I was the Chief Justice of Nigeria I met a girl Maryam.  ABU Zaria 1976- 1980, LL.B (Hons) enrolled as a Barrister and Solicitor of the Supreme Court of Nigeria 1981. Yes I married her as my 4th wife and so what is the problem now?

CA: There is no problem my Lord and your Lordship may marry an intern if you like as long as she consents to the marriage and above 18 years of age and accords with her background. Never mind you are now 80 and she is 65?. However the Legal Practitioners Act and the LPRC approve your private relationship and the Nigerian Constitution too!
Only she is interfering  my Lord and that I find objectionable my Lord sorry she is not my model.

My Lord I am a Vital Voices Lead Fellow a global partnership founded by former US Secretary of State Hillary Clinton the first female presidential candidate of a major political party in US and by the Grace of God will be first female President of the United States of America Nov.  We Will Win! Never mind the email controversy and Donald Trump’s jabs that she lives off government jobs.

US Senator Elizabeth Warren, Democrat is with her. Warren missed being picked as VP but she is still with Hillary.  3 days ago Trump made a veiled threat to ‘kill’ Hillary ref 2nd amendment, US Constitution, right of US citizens to own guns. And here is what Elizabeth Warren a law professor, my model says:  “Trump is a pathetic coward he can’t stand losing to a Girl”. That is what we are “girls aspiring to rule the World”. Ma’ame said she is not a girl that is her choice. I am a Girl Sir and if Madam is upset about ‘Girl’ does she want to jump? That isn't necessary.
