NNEWI: WHEN A COURT HAS NO JURISDICTION, THE LAWSUIT IS DECREPIT!


In ADEGBOLA vs- OSIYI (2018) 4 NWLR (Pt. 1608) page 1 @ 10 para D-F the Supreme Court held that JURISDICTION is the very basis upon which any court tries a case. It is the lifeline of all trials, as a trial without jurisdiction is a nullity. Those forum shopping in Nnewi, Anambra State High Court without jurisdiction to hear and determine  the issues of disqualification by EC NBA of a presidential hopeful when the NBA secretariat/EC NBA in Abuja note that should NBA not respond to your process, it is decrepit, your  said court process not being a libel suit, stays creaky. When you decide to appear in the appropriate court, you would be met with the  principle, ex-turpi causa non oritur actio.

Look,  the anti-corruption libel suit filed by Etiaba in Port Harcourt against Minister Lai Mohammed for publishing his client(s) names as corrupt people when there was no order of court certifying him or them as  such, the un-reported (celebrated) case of FHC/L/CS/1296/2012   Counterclaimant BABALAKIN vs- AMCON judgment delivered on 13th June 2018, rests it. The Federal High Court per coriam Buba J., at page 59 of his judgment awarded the sum of N3Billion as counter-claimed by Resort Intl Ltd and Dr Wale Babalakin against AMCON for publishing his/their names as chronic debtor(s) when there was no order of court adjudging him/them as such or authorizing the publication. I actually obtained CTC from the Federal High Court Lagos.  And I have relied on the locus celebra in a N2Billion claim at the Federal High Court.

AFAM'S LAWSUIT: FAKE OR FACTUAL?


AFAM’S LAWSUIT:  FAKE OR FACTUAL?
On Wednesday  11th July, 2018 he posted on his Facebook Wall that he ‘had to take the difficult decision of instituting an action against  the NBA..’ – Mr Afam Osuigwe’s words. 

 On Thursday 12th July instant,  I read his post and asked for the minutest details such as suit number, the COURT he allegedly instituted it and the reliefs sought. He wasn't my presidential hopeful anyway. I mean I couldn’t  endorse one who in conjunction with Alegeh sponsored gang rape online  against Lawyers  who disagreed with them DISGUSTING, utterly unprofessional. Propensity for violence is not part of our ethics and laws, Sirs.  

Dr  Odinkalu,  human rights lawyer, shouldn’t  your learned friend respect gender rights.   I couldn’t  have  stood bye to watch the most egregious  infraction by people who should know better without taking exception to Afam’s candidature at our NBA election into the most exalted office.  I had perceived that Afam Osuigwe was desperate to return to NBA House to continue with their notorious policy against peace and security of our women. 

Always bear in mind the phrase, “women’s rights are human rights”  imbedded in a speech by Hillary Clinton as the First Lady of the United States in Sept., 1995 at the UN Conference on Women in Beijing.  Clinton had used the phrase within the bidirectional  posture:  “human rights are women’s rights and women’s rights are human rights” and the phrase has come to stay in the human rights community. 

As I was saying up and till now the Osuigwes have not disclosed where the suit was instituted. Maybe it takes this long to provide simple information. When he wrote to NBA to protest his disqualification, he shared the exact content of his NBA correspondence on his Facebook. NOW please do respect the rule not to comment on his pending litigation unless they are saying Afam’s lawsuit is Fake or Fictitious?.

NOBLE NBA GREAT IDEAS: STAMPS AND SELF-ADHESIVE


Dear Learned Friends,

I have just received a Whatsapp text from a junior colleague  I respect so much given his learnedness and civility. He is not into Cultism although his friend “uncleared” for the office of the NBA President.   This particularly respectful and respected junior is a prominent member of NBA Abuja Branch. I will not mention his good name However I seek to address his query by  this open reply for us all.

My Learned Colleague in whom am well pleased is very cordial with Lawyers generally; he wrote to me this Tuesday morning in effect that I said Arthur Obi Okafor’s email on women and young lawyers  enthralled and also Ernest Ojukwu’s proposal  on  free NBA Stamps and seal for members who pay their bar practice fees. Actually Arthur Obi Okafor made a similar proposal on free stamps but it does appear Ojukwu’s emphasis is, the NBA stamps come free and members  would  receive same digitally upon payment of BPF.  The challenge there is the stamps are meant to be self-adhesive hence digital stamps may not work.  I thank Prof Ojukwu for his great ideas moving the NBA forward via his proposal on digital stamps, a couple of days ago. 
Let us look to see who makes a proposal to implement NBA Stamps and seal at the various land registries with a view to increasing work on legal documentation for leases, assignments, mortgages etc. I did long ago indicate that the Legal Practitioners Remuneration Order  (LPRO) 1990 which specifies a charge for solicitors work is Great! Because  if you prepared a deed of assignment and the consideration is say N200Million your fee would come to say N20M or thereabout. NBA should work to protect legal jobs in addition to flushing out fake lawyers. Those who encroach on legal work are not NBA-Friendly. 

I did a few days ago also expressed gratitude  re:  Arthur Obi Okafor (SAN )’s proposal for women and young lawyers he said he would ‘genderize’ NBA committees, statutory bodies, NEC.  He also sought to reduce certain AGC fees. Additionally, he proposed to amend the NBA Constitution to bring in learned juniors between 7-9 years post-call into NEC and I did say that is great. I made NEC at a slightly younger age and was actually the youngest Lawyer of NEC 1990-1991. Thanks to NBA Presidents Priscilia Kuye and Clement Akpamgbo SAN.

With respect to Paul Usoro SAN the most senior, most  savvy of all the presidential candidates, please let me say in fairness to USORO SAN  he was  actually the first this election year to take a position on  female colleagues/ Genderizing the Bar to the  extent AWLA – Association of Women Lawyers endorsed Paul Usoro SAN months and weeks ago and right here in OurCountryNigeria internet forum, I commended Paul Usoro severally for his giant strides on Gender.

I don’t want Lawyers to keep saying I am not showcasing the good sides of other candidates because as you know the Dame of the Bar is FAIR. By the way few days ago I saw a lawyer who never fought a single battle say to Facebook readers  - referencing Amazoning NBA. You have to have professionally wrestled on your own some Titans to earn the sobriquet,  AMAZON. It is not when a male lawyer says go and slap that Gal and you land a dirty slap on her face and you return  to  report to sender, done,  instruction to slap an innocent Gal DONE!  That makes you an Amazon. YOU CAN NOT EARN THE AMAZON TITLE CHEAP. It’s alright to slap without a cause but then it would mean you are just somebody’s good girl, period.  NOT AMAZON.  
As I was saying to exemplify FAIR, I brought out positive angles of AOO and EO’s campaigns without prejudice to my candidate Usoro SAN.  We are in a professional race that brings out the BEST.

SA FEMI ADESINA'S DAUGHTER TO DAD: 'I NEVER KNEW YOU TO BE BLOOD THIRSTY'

He was Editor-in-Chief Sun newspaper also he
was MD, was President Nigerian Guild of Editors.
He was a very decent man, almost Christ-like. His daughter was right that is not her Dad who now approves blood spilling, in front of the public asking people to give up their ancestral land or be killed.

NBA AGC 2018: SPEAKERS WITHOUT TOPICS?!


Dear Learned Friends,

The age given by God to everyone  is 120 years. Matter of conscience Chief Tunji Gomez Esq is 91 and fully mentally alert and active. He attends NBA Lagos premier branch meetings. He is active online/on Facebook; concedes points emphasizes his viewpoint very professional.

Maybe we should have appointed a 91-year old with energy to host the conference because I do not understand George Etomi’s TCCP. Professor Konyinsola Ajayi SAN (KA) and George Etomi (GE) seem about contemporaries. Whilst Savvy and intellectually suave KA does not conduct as though too Old man looking for direction, unsure. GE who is equally savvy and intellectually suave is now conducting as if he is an old man looking for direction over NBA conference 2018 he graciously accepted to organize.  I mean how do you explain on NBA Conference page you are told early bird for those above 20 years at the bar, N100,000= Same rate as 2017.  Mid registration is N150,000= and Late registration N300,000= for delegates in my category without stating the start point and the end for each category. GE has organized successful conferences and seminars he is a great organizer. How can he not disclose the following vital information to members:
1.  What is early bird. I read a private message that early bird is July 31st Why is it difficult to disclose this piece of information to prospective delegates to enable planning for attendees.

2.  TCCP has not told us what to expect when we pay AGC fees. KA in 2017 listed what to expect such as NBA AGC Tablets 2017 which came with a sim card and subscription to LegalPedia, etc,

3.  SPEAKERS WITHOUT TOPICS: Apart from the conference theme, TCCP under GE couldn’t identify any topic as if they are mentally lazy when we are aware they are some of the brightest in NBA. Rather TCCP pasted images(photos) of some unknown people some Africans some Americans and others as AGC speakers. The names were not tagged thereto. The topics they would be speaking on un-disclosed. What are they going to be talking on?. That is how ABA, IBA work and NBA under TCCP Chair KA did.

4.  ACCOMODATION: There is no useful information here. TCCP just wrote the word, accommodation without a list of any hotel(s).

5.  On the NBA conference website members see nothing inspiring. I actually wanted to register I clicked on register and I was expecting to read these are the expectations when I found none so I held on securely to my credit card. I am prepared and willing to register only if they are willing and prepared. If we are not ready for the conference as a result of the devastating effect KA’s resignation had,  we should have rejected KA’s resignation and allowed him proceed such that whatever differences he had with whomsoever ought to have been resolved to NBA’s glory.

Karimu v- Olawure: Osuigwe Stop Your Infantile Tantums Against NBA

his video has given us an account of what happened. A younger lawyer
was owed salary by an older lawyer, his former employer who had issued a cheque to the younger lawyer who went to the bank to cash it but he was told to return it to his former employer to sign to enable immediate access. The younger lawyer returns to the law firm of Oluyomi Olawure and an argument ensued. The older lawyer calls in the police to restore order. Police slapped the younger lawyer and in any event the older lawyer said in this report he did not authorize police assault he then signs the cheque to open it and I think it has been cashed by the younger lawyer.

Now Afam Osigwe took to Facebook to lampoon the Nigerian Bar Association NBA translated NBA President AB Mahmoud SAN and the national officers none of whom authorized the assault. Matter of fact since 2016 when he assumed office AB Mahmoud SAN did not assault a single lawyer unlike Alegeh-Afam Osigwe's  regime. I could supply the names of lawyers assaulted 2014-16 by Messrs Alegeh and
Afam Osigwe some at NEC meetings. What Afam Osigwe ought to have done if he is keen in fighting public interest causes, he should have called both lawyers to find out what happened and if the younger one was being owed he should say to the older one please pay the gentleman ASAP and he could go a step further to inquire who authorized the assault and if the former employer  didn't, you ought to file a fundamental rights enforcement procedure lawsuit
on behalf of the young Lawyer Gbenga and offer pro bono legal services.

That was how Gani Fawehinmi SAN would have fought. That is how Falana SAN Works. That is how Olisa Agbakoba SAN agitates. That is how Festus Keyamo SAN Ebun Adegboruwa just name any human rights lawyer would worry. Afam Model on any of these HR Lawyers and others and stop blaming NBA on this account.
