US: If Justice Scalia Was of the Supreme Court Nigeria.....

Chief Oyegun Sir,

In the news, US lost a Judicial Gem. Justice Antonin Scalia died two days ago in a West Texas ranch. He was at a private party with 40 people and  couldn’t join others for breakfast the following day, Saturday,  as planned and when the owner of the ranch went to get him, the eloquent Judge was lying peaceably still.

Justice Scalia was the longest serving JSC;   he was nominated by Ronald Reagan in 1986. Here is a photograph of the ranch where he had gone hunting. http://www.nytimes.com/2016/02/15/us/ranch-owner-recalls-finding-justice-antonin-scalias-body.html?_r=0

Conservatives like him, liberals don’t,  he had a “fierce intellect” whether you agreed with him or not. Known for promoting the concept of “originalism” ie interpret the law to reflect what it means contextually, originally. If Justice Scalia was one of the 7 JJSC  he would have come to the same verdict as  Kekere-Ekun JSC and her Brother and Sister Judges that card readers cannot  supersede voters register in Akwa Ibom and Rivers State and the Oil rich South.

Yesterday I read you indicate to the media “not worried” and that is a wise decision as you have majority of the 36  States and the Big Centre.  APC cannot take all the States which is the good thing about these decisions.

Your supporters should underscore Scalia at a private party, was alone. Good! A few days ago I saw a picture trending of former Gov Akpabio and the CJN at an official event in the midst of a crowd at an official cocktail event. Scalia was not at any official party in West Texas.  Mr Akpabio was enrolled as Barrister of the Supreme Court of Nigeria decades ago before he joined politics now Senate Minority Leader, PDP.

Recall Bush vs- Al Gore.    Should President Obama nominate a replacement for the  outspoken  Scalia or wait for the next administration to make a decision? Obama said he will make the nomination now  because as you all know appointment to the Supreme Court is a life tenure hence most enduring legacy.  Republican Majority Leader McConnel insists the next regime should make the appointment that has a potential to tilt the Supreme Court towards liberals.  Presently, 8 Justices and that could move the US SC into tie votes all the time, in some of the slated landmark cases.

Acting on a spur of the moment President Buhari sacked a dozen Vice Chancellors and made lopsided replacements favourable to Kano State against protestation and if that is politically just, how is it fair?

Muhammadu Buhari could transfer his “unguarded anger, unlawful malice” to VCs but he cannot touch any JJSC until they attain the retirement age of 70 in Nigeria.

Thank you.

Attorney CN Ajie
